By accessing or using Famus ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the Service.

2. Eligibility

You must be at least 17 years old to use Famus. By using the Service, you represent that you meet this age requirement.

3. Account Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

4. User Content

Your Content

You retain ownership of content you create and share on Famus. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the Service.

Content Guidelines

You agree not to post content that:

• Is illegal, harmful, threatening, abusive, or harassing
• Contains nudity, sexual content, or pornography
• Promotes violence or discrimination
• Infringes on intellectual property rights
• Contains malware or harmful code
• Is spam or deceptive
• Violates the privacy of others

5. Live Streaming

• You are solely responsible for the content of your live streams
• You must comply with all applicable laws while streaming
• You may not stream copyrighted content without authorization
• You may not stream content that violates our content guidelines

6. Monetization

Duckets (Virtual Currency)

• Duckets are virtual currency that can be purchased and used to tip creators
• Duckets have no real-world value and cannot be exchanged for cash
• All Duckets purchases are final and non-refundable
• We reserve the right to modify Duckets pricing and functionality

FamPass (Subscriptions)

• FamPass subscriptions are recurring monthly payments
• You can cancel your subscription at any time
• Refunds are handled according to the platform's (Apple/Google) policies

Creator Payouts

• Creators receive 90% of tips and 75% of subscription revenue
• Payouts are processed bi-weekly
• Minimum payout threshold may apply
• You are responsible for reporting income and paying applicable taxes

7. Prohibited Activities

You agree not to:

• Use the Service for any illegal purpose
• Impersonate any person or entity
• Interfere with or disrupt the Service
• Attempt to gain unauthorized access to other accounts
• Use bots, scrapers, or automated tools without permission
• Circumvent any access restrictions or security measures
• Engage in harassment, bullying, or threatening behavior

8. Intellectual Property

The Famus name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Famus. You may not use these without our prior written permission.

9. Third-Party Services

The Service may contain links to third-party websites or services. We are not responsible for the content or practices of these third parties.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAMUS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

12. Indemnification

You agree to indemnify and hold harmless Famus and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your account at any time for any reason, including violation of these Terms. Upon termination, your right to use the Service will immediately cease.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes by posting a notice on the Service or sending you an email. Your continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by the laws of the United States, without regard to conflict of law principles.

16. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except for claims that may be brought in small claims court.
