Terms of Service

1. Acceptance of Terms

By accessing or using Famus ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the Service.

2. Eligibility

You must be at least 17 years old to use Famus. By using the Service, you represent that you meet this age requirement.

3. Account Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

4. User Content

Your Content

You retain ownership of content you create and share on Famus. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the Service.

Content Guidelines

You agree not to post content that:

• Is illegal, harmful, threatening, abusive, or harassing
• Contains nudity, sexual content, or pornography
• Promotes violence or discrimination
• Infringes on intellectual property rights
• Contains malware or harmful code
• Is spam or deceptive
• Violates the privacy of others

5. Live Streaming

• You are solely responsible for the content of your live streams
• You must comply with all applicable laws while streaming
• You may not stream copyrighted content without authorization
• You may not stream content that violates our content guidelines

6. Monetization

Duckets (Virtual Currency)

• Duckets are non-cash platform credits that supporters can buy and use for eligible creator-support features
• Supporters cannot redeem, withdraw, or exchange Duckets for cash
• Purchased Duckets do not expire
• When a supporter spends Duckets on an ordinary tip, each Ducket represents US$0.01 of gross creator-support value before the allocation below
• Refunds and reversals are handled under applicable law and the purchasing platform's policies; refunded or disputed purchases may remove unused credits or adjust related pending earnings

FamPass (Subscriptions)

• FamPass subscriptions are recurring monthly payments
• You can cancel your subscription at any time
• Refunds are handled according to the platform's (Apple/Google) policies

Creator Payouts

• Ordinary Ducket tips without an assigned moderator allocate 95% to the creator and 5% to FAMUS, subject to whole-Ducket rounding
• Ordinary Ducket tips with an eligible assigned moderator allocate 90% to the creator, reserve 5% for eligible moderator compensation, and allocate 5% to FAMUS, subject to whole-Ducket rounding
• The moderator reserve is not a promise that moderator service is available or that the reserve alone satisfies any wage or compensation requirement; any paid moderator program is subject to separate eligibility and terms
• Super Chat uses a separate 90% creator / 10% FAMUS allocation
• FamPass and gifted-FamPass creator shares are Foundation 60%, Ascent 65% after $500 in cumulative successful payouts, and Apex 70% after $2,000 in cumulative successful payouts. Zenith 75% and Pharaoh 80% are not active payout tiers
• Payouts are processed on the 1st and 15th of each month through Stripe when onboarding and transfer eligibility are complete
• The first 100 eligible Founder creators have a $25 minimum payout balance; the standard minimum is $50. Lower balances roll forward
• Incomplete payout onboarding holds otherwise valid earned funds; it does not waive or forfeit them
• You are responsible for reporting income and paying applicable taxes
• FAMUS and its payment providers may collect information and provide tax forms as required; the applicable form depends on the payment relationship and law

7. Prohibited Activities

You agree not to:

• Use the Service for any illegal purpose
• Impersonate any person or entity
• Interfere with or disrupt the Service
• Attempt to gain unauthorized access to other accounts
• Use bots, scrapers, or automated tools without permission
• Circumvent any access restrictions or security measures
• Engage in harassment, bullying, or threatening behavior

8. Intellectual Property

The Famus name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Famus. You may not use these without our prior written permission.

9. Third-Party Services

The Service may contain links to third-party websites or services. We are not responsible for the content or practices of these third parties.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAMUS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

12. Indemnification

You agree to indemnify and hold harmless Famus and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your account at any time for any reason, including violation of these Terms. Upon termination, your right to use the Service will immediately cease.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes by posting a notice on the Service or sending you an email. Your continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by the laws of the United States, without regard to conflict of law principles.

16. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except for claims that may be brought in small claims court.
